In Azerbaijan, in the event of a retirement pension, the difference will be held from the official whose fault the error occurred, the corresponding article is included in the law “On labor pensions”.
according to the new article, with the exception of cases when the amount of re-payment of the already paid retirement pension or the allowance for it is withheld from the pensioner in accordance with Articles 39.1 and 39.1-1 of this Law, in the case of reassignment of the retirement pension or allowance to it due rude negligence or intentional action on the part of the official, the amount of re -payment will be held from this official or by his consent, and in the event of a refusal – in court.
