Court in Armenia ruled in favor of Kocharyan

The Constitutional Court of Armenia recognized the Article 300.1 of the Criminal Code of the country (the overthrow of the constitutional system), which is accused of the country of Robert Kocharyan, is accused, Interfax is accused.

“Recognize Article 300.1 of the Criminal Code of Armenia contradictory items 78 and 79 of the Constitution and invalid,” the court decision was read by the Chairman of the COP Arman Dylanan.

Article 78 of the Constitution of Armenia – the principle of proportionality: “Measures chosen to limit fundamental rights and freedoms should be suitable and necessary to achieve the goal established by the Constitution. Measures chosen for restrictions should be proportionate to the importance of limited fundamental rights and freedoms” .

Article 79 of the Constitution – the principle of certainty: “When restricting fundamental rights and freedoms, laws must establish the grounds and the amount of these restrictions, to be sufficiently certain that the carriers and addressees of these rights and freedoms are able to show appropriate behavior.”

According to Cocharyan’s lawyers, criminal prosecution against Kocharyan should be discontinued.

Kocharyan was arrested in Yerevan in July 2018 after he was charged with overthrowing the constitutional system in the case of March 2008 events. In June 2020, Kocharian was released from custody of about $ 4 million
