Ismail found kilogram of heroin, but court acquitted it

In January of this year, the police conducted an operation in the house of Ismail Falchenko, a resident of the Baku village of Govsan. During the search, law enforcement officers found a kilogram of heroin, and the man was detained. However, the court could not prove the guilt of Falchenko and justified it.

The case of 47-year-old Falchenko recently examined the Baku court for serious crimes. According to the investigation materials, during the detention, they found 5 packages with methamphetamine, a kilogram of heroin and electronic scales.

During the interrogation in court, Falchenko did not find himself guilty of the charges against him. The previous testimony, according to which he confessed to the offense, the man explained by pressure on him and emphasized that he did not sign anything.

Falchenko said that law enforcement officers actively used physical impact – in particular, his mother was forced to go to the hospital due to injuries received during the search of the house.

The defendant admitted that he used drugs in small quantities. So, a few days before the detention, he bought 5 grams of opium and partially used them. Note that on the day of detention in the house, opium was indeed found. At the same time, Geroin Falchenko resolutely refused the kilogram, saying that the drug was “thrown to him”.

The testimony, the data of Falchenko in court, were analyzed and compared with the case file, as well as with the testimony of questioned witnesses. As a result, the court did not recognize the belonging of the found drugs to the defendant. Falchenko was released in the courtroom. A man’s complaint about the physical pressure exerted at him in the police department was not satisfied.
