Kocharyan can make a new charge

Against the ex-president of Armenia Robert Kocharian, a new accusation can be launched. This opportunity did not exclude the prosecutor Gevorg Baghdasaryan. Reports about it Sputnik Armenia.

In April, the court of general jurisdiction in Yerevan decided to stop the case against Kocharyan on the basis of the recognition by the Constitutional Court contrary to the Basic Law of the article on the overthrow of the constitutional system on which the investigation was conducted. Kocharyan was released from under the guarantee and other restrictions on this case.

Now the criminal case can retrain within the framework of another article of the Criminal Code. As the prosecutor Gevorg Baghdasaryan explained to journalists, the prosecution believes that the decision of the COP, according to which the article incriminated by Kocharyan is recognized as an anti-constitutional, was taken with violations. First, the COP meeting was held in the absence of defendants – Kocharyan and others, the law obliges them to attend the meeting. Secondly, the recognition of an articles of anti-constitutional does not mean the absence of a crime. Thirdly, those norms of the Criminal Procedure Code, which applied the court of first instance during the termination of criminal prosecution, contradict the Constitution. Public prosecution now hopes that the COP will decide whether to nominate the new accusation of Kocharian.

Case against Kocharian concerns the events of March 1-2, 2008. Then he introduced a state of emergency in the country to disperse the oppositionists who came to the street – supporters of the first president of Armenia Levon Ter-Petrosyan, who participated in the 2008 elections, but suffered a defeat.
