illegal money transfers from Azerbaijan abroad or from abroad to Azerbaijan by compensation and in other ways of mutual settlements, if these actions are committed without signs of smuggling in a significant amount, that is, worth more than 50 thousand manat, but not more than 200 thousand manat , will be punished with a fine of 40 percent of the value of the subject of the crime, as well as a fine of 40 percent of the cost of the subject of the crime and restriction of freedom for up to 2 years. This is reflected in the Law “On Amendments to the Criminal Code of the Azerbaijan Republic”, the decree on the application of which was signed by President Ilham Aliyev.
The commission of the same actions by officials using their official position or on a large amount, that is, in the amount of more than 200 thousand manat, but less than 500 thousand manat will be punished with a fine of 40 to 60 percent of the value of the subject of the crime, or a fine In the amount of 40 percent of the value of the subject of the crime and restriction of freedom for a term of 2 to 4 years, or by deprivation of liberty up to 3 years.
The commission of these actions on an especially large amount, that is, in the amount of more than 500 thousand manat, will be punished with a fine of 40 to 60 percent of the value of the subject of the crime or restriction of freedom for a term of 3 to 5 years, or by deprivation of liberty for the term from 3 to 5 years.
In accordance with another change made to the Code of Administrative Assignments, illegal money transfers from Azerbaijan abroad or from abroad to Azerbaijan by compensation and other methods of mutual settlements, if these actions are performed in a small amount, that is, less than less than 50 thousand manat, will be punished with a fine of 40 to 60 percent of the amount of transfers, which is the direct object of administrative misconduct.
According to the decree, a preliminary investigation in these criminal cases will be conducted by the State Tax Service at the Ministry of Economics, where the case has been instituted, or the state security service of Azerbaijan.
